ZIMBABWE – The matter in which ousted Hurungwe West legislator, Themba Mliswa, is challenging by-election results which saw Keith Guzah emerging victorious has commenced at the High Court.
Mliswa has since re-engaged his lawyers, Hungwe and Mandevere. It is understood that Tendai Biti had assumed agency but without explanation Mliswa is now represented by Kudzai Kadzere of Hungwe and Mandevere.
Mliswa alleges that he was arrested without cause while state security agents were used to intimidate the electorate, making the holding of a free and fair by election impossible.
He singled out Zanu PF Secretary for Administration, Dr Ignatius Chombo and Home Affairs Deputy Minister Ziyambi Ziyambi for spearheading the electoral fraud.
Justice Tendai Uchena asked Mliswa’s defence counsel why Mliswa had not cited Chombo and Ziyambi and the lawyer responded that their issue was against Guzah who allegedly won the Hurugwe West by-election owing to vote buying, meting out violence
against people perceived to be in support of Miliswa’s candidature.
Advocate Sylvester Hashit, who is representing Keith Guzah in the matter objected to Mliswa giving hearsay evidence and sticking to what he perceived with his own eyes.
The matter continues before Justice Uchena with Mliswa’s witnesses taking the stand.
