MDC-Alliance vice chairman, Job Sikhala’s High Court appeal was on Wednesday postponed to Friday because the magistrates are reportedly refusing to sign the record proceedings from the lower court.
Jeremiah Bamu (Sikhala’s lawyer) revealed this on Wednesday when the matter was brought before Justice Erica Ndewere.
Sikhala is facing charges of inciting public violence after supporting the 31 July anti-corruption protests.
He has been in prison for two weeks and was denied bail by magistrate Lazini Ncube who said the Zengeza West legislator was a flight risk.
Bamu told Justice Ndewere that “the appellant’s record could not be availed as there was no Magistrate willing to sign it since Magistrate Lazini Ncube who presided over the case is on leave.”
It is also reported that Chief Magistrate, Munamato Mutevedzi refused to go over the records citing that it was too long and therefore did not sign it.
Sikhala’s initial challenge of his placement on remand after being arrested was also quashed by Ncube who stated that there was reasonable suspicion that Sikhala had committed the offence he is being accused of.
