HARARE – The High Court has dismissed an urgent application filed by an executive director of a Local NGO seeking to have Chief Justice Luke Malaba arrested for contempt of court.
Two high court judges namely Amy Tsanga heard the case after another judge Webster Chinamora recused himself from the bench citing professional reasons.
The technical part of the judgment read, “The application for civil imprisonment for the first respondent (Malaba) contempt of court is dismissed. “
The contempt of court case was sparked after Chief Justice Malaba returned to work after the high court had illegally ruled as illegal his term of office extension by President Emmerson Mnangagwa.
However, the Attorney General as well as the Minister of Home Affairs and Cultural proceedings then launched appeals on the judgment resulting in CJ Luke Malaba returning back to work.
Mr Musa Kika then launched an urgent application seeking for the CJ to be imprisoned for six months if he was found to be in contempt of court
